SBA Construction Update

In a Construction Lending Session held by SBA on June 22, 2023, the SBA provided a reminder that SBA SOPs provide explanatory language and guidance based on statute and the Code of Federal Regulations (CFR). The CFR is the codification of general and permanent rules published in the Federal Register by the executive departments and agencies of the Federal Government. The SOP 50 10 7 no longer has explanatory text on certain topics, but statutes and regulations continue to apply.

7(a) Fees Effective October 1, 2023, for Fiscal Year 2024

Each year the SBA reviews certain fees payable to SBA by 7(a) Lenders (“Lenders”) and borrowers to determine the appropriate fees to manage the estimated costs of the 7(a) loan program. This announcement includes updates to the Lender’s Annual Service Fee and the SBA Guaranty Fee.

Fee Disclosure and Compensation Agreement For use with 7(a) and 504 Loan Programs

The purpose of this form is to identify Agents and the fees and/or compensation paid to Agents by or on behalf of a small business applicant (“Applicant”) for the purpose of obtaining or expediting an application for a loan guaranteed by the U.S. Small Business Administration (SBA). This is a statutory requirement under 15 U.S.C. 642. See 13 CFR Parts 103 and 120 and SBA’s Standard Operating Procedure 50 10 for the rules governing compensation of Agents or SBA Lenders in connection with an SBA loan.  Expiration date: 11/30/2024

Lender Update: 5000- 843625 IRS issues updated IRS Form 4506-C

The purpose of this Notice is to inform all SBA employees and SBA Lenders that the Internal Revenue Service (IRS) has released an updated version of IRS Form 4506-C for use by authorized IRS Income Verification Express Service (IVES) participants (revision 10/31/22).
